Terms of Service

By accessing or using the hail platform, you agree to be bound by these Terms of Service. If you do not agree, you must not use the service.

Service Description: hail provides a cloud-based platform for PDR (Paintless Dent Repair) technicians to manage work orders, invoices, clients, and payments. We reserve the right to modify or discontinue the service with reasonable notice.

Account Responsibilities: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

Subscriptions and Billing: Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing you authorise Stripe to charge your payment method on a recurring basis. Prices are displayed inclusive of applicable taxes. We reserve the right to change pricing with 30 days' notice.

Cancellation and Refunds: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods, except where required by applicable law.

Acceptable Use: You agree not to use the service for any unlawful purpose, to violate any applicable laws or regulations, to transmit harmful or fraudulent content, or to attempt to gain unauthorised access to any part of the service or its infrastructure.

Intellectual Property: The hail platform, including its software, design, and content, is owned by hail and protected by intellectual property laws. You retain ownership of the data you create within the platform. You grant us a limited licence to host and process your data solely to provide the service.

Limitation of Liability: To the fullest extent permitted by law, hail shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Termination: We may suspend or terminate your account if you breach these terms or if required by law. You may terminate your account at any time. Upon termination, your right to use the service ceases immediately.

Governing Law: These terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

Changes to These Terms: We may update these terms from time to time. We will notify you of material changes at least 30 days in advance. Continued use of the service after the effective date constitutes acceptance of the updated terms. For questions, contact us at hello@hail.app.
